Emergency Practice Directions for the FTT and UT

The Senior President of Tribunals has published two practice directions (19.3.20). They apply to all Chambers of the FTT and UT (‘tho readers of this blog are most likely to be familier with the FTT(PC) and UT(LC)). They are here and here. They have an initial life span of six months.

The Contingency Arrangements PD establishes that paper determinations are to be (in effect) the default position. If an oral hearing is required then parties will appear remotely. Site inspections in the FTT(PC) are suspended. Evidence from photos or videos is to be used instead or the FTT can do a “drive by” viewing. If a site visit is crucial then the case is stayed until further order.

The Panel Composition PD provides for a panel of one person to be permitted (whereas it would normally be two or three in the PC).

So, if you’ve got an FTT(PC) hearing in the next six months, it isn’t happening as an in person hearing.
